Fiance Visas to Australia
FIANCE (FIANCEE) VISA (Prospective Marriage Visa)
This is the Australian visa-of-choice if you are planning on marrying, and are happy to marry your Filipino girlfriend in Australia. If you have met each other in person, have a genuine intention to marry, and have evidence to prove this, you may apply for this visa. You apply, you wait for it to be granted, and your fiancé (fiancée) comes to Australia on a Subclass 300 temporary visa.
A condition of the fiancée visa is that you (a) may not marry outside of Australia, and (b) must marry within 9 months of the GRANT of the visa (not when you arrive).
Once you are married, you apply to the Department of Immigration and Citizenship (with evidence of the marriage) and may be granted a Subclass 820 temporary partner visa.
If you are still together (and can prove this) after 2 years, you may be granted a Subclass 801 PERMANENT partner visa. Please note that you apply for the Subclass 820 and 801 at the same time.
Please note that these visas require you to be SPONSORED by your partner/spouse/fiancé, and this means that they must be eligible to sponsor you. They must be able to support you financially, because you are not entitled to make any claims for social security benefits from the Government for at least 2 years.
The visa may be granted to you, and may also include any dependent children that you have. Your dependent children are granted the same visa as yourself, and enjoy the same rights to permanent residency as you do.
What does Down Under Visa do for you?
We take away the guesswork, and we reduce the chances of failure. Finding the love of your life….that person whom you plan on spending the rest of your life together with……too important to mess about with, and too big a risk in order to save a few dollars. We know the law, and we know the culture and the way things work in the Philippines.
If you engage our services to manage your visa application for you, then you know you are in safe hands. We never let a client down. Difficult and problem cases just make us try that bit harder. You don’t have to worry or wonder what the requirements actually mean, because you are in the hands of the experts. We understand the complexities of Migration Law, and we understand the people, the culture and “the system” in the Philippines. Your chances of success are so much higher.
We’re not just another “visa business”. Our service is friendly and human, as well as highly professional. We know we’re dealing with real people with hopes, dreams and fears. We’ve been there ourselves afterall. We truly care about the outcome of your application, which is why we have such a high success rate.
We can (and do):
- Assess your case and advise you on a workable strategy based on Australian Migration Law,
- Find solutions for problem cases when the situation appears hopeless, or where you’ve had a visa cancelled or a visa application refused
- For applications in Philippines, we can help provide guidance for obtaining necessary visa requirements (ie. documents and evidence of your relationship) and to avoid the issues of fake documents and false information
- Provide personalised step-by-step guidelines, supportive documents and checklists listing and explaining all the requirements for a successful Australian visa application. We also check that your visa requirements are correct
- We lodge each visa application with a legal submission which outlines how your application meets the legal criteria for a visa grant (in accordance with the Migration Regulations), and prepare your application in a professional manner that DIAC (the Department) consider “Decision-Ready”.
- We submit the application to the Department, and we act as the liaison with the Department all the way through to the point of the visa being granted.

Jeff Harvie with a Client in the Down Under Visa Office
Have you met the girl of your dreams in the Philippines? Have you decided you want to bring this Filipina lady with you to Australia where you will marry her? Have you looked up the Australian visa requirements on the Department of Immigration and Citizenship website and realised that this is not so easy? There is not a lot of room for error, and there is a real risk of visa refusal if you don’t get this right. We understand what you’re going through, and we understand how it feels. We, Jeff and Mila Harvie, went through all of this ourselves years ago when Mila came to Australia on a fiancée visa. This is what made us venture into Migration Law practice in the first place. We specialise in fiancée visas* and spouse visas from Philippines. In fact this is 99%+ of what we do, along with tourist visa applications.

We will manage your case and your Australian visa application by assessing your case, assessing and recording your personal information, helping you and your Filipina girlfriend or fiancee prepare all your personal documents and specific visa requirements, preparing and lodging your visa application with a proper legal submission, and personally dealing with issues that may come up with the Department (Manila Embassy, ie. the Australian Embassy in Philippines), right down to when your fiance visa (aka fiancee visa) gets granted.
If your fiancée is from the Philippines, we can provide a level of service and insights second to none. Why is this? Because we’ve been through the migration process ourselves (Jeff & Mila are an Australian/Filipina couple), and we have our main office in the Philippines (in Muntinlupa, Metro Manila). We can guide you through the “system” in Philippines for obtaining correct documents and other visa requirements, and can help with personal issues and cultural issues that may confuse and frustrate you along the way.
